He's not saying everyone just those who do decide to tune, at least that's how I took it. Which like I said if you make the decision you don't care, are an idiot or don't care because you're an idiot. As far as the reflash back to normal by Nissan with some kind of lockout, much like the Playstations this car was based upon and their battle with gameshark/mod devices there will always be a way around whatever they try to do.
