like everywhere else download has always been legal the problem is that uploading isn't.

There is an ad campaign going on on TV in Qc. Artists ask people to buy music because not buying CDs not only hurts artists, but everyone who is involved in the industry (graphists, PR people, marketing, etc).
I think it is a legitimate cause... for small artists though. I'll keep d/l international artists... but I'll buy CDs of my favourite local (smaller) artists.

So in a peer-to-peer situation the Canadian law sees the actively downloading peer as legal - but the passively uploading peer in that transaction illegal?
Since, technically the bits being peer dowloaded are actually being peer uploaded at the same time
This means that LEECHING is the only legal activity left

There is no way that they are going to stop the sharing of mp3, and I think the fee on mp3 players is a pretty good idea

Bad news, the National Post reported today that in the new year, record companies are planning lawsuits in Canada similar to the ones that began in the US this year. There were some quotes from a lawyer who specializes in internet law and he thinks the suits will be dificult to win for the record companies due to the law we've already been discussing here. But he thinks that if the companies decide to bring suits against the uploaders, those poor saps will be screwed. A representative from one of the record companies said they've been collecting information on Kazaa users for a few months now. :cry:

although mp3 is legal.. there are still many things illigal in canada that is perfectly legal in the US and other places..
ie. u still cant import cars such as R34, R33, S14, S15, MR-S, etc into canada..

There's lots of cool stuff in Canada that's legal.
It's nice that they've imposed this little fee to help out the musicians, but shame that all the money from it will go to the record producers (or other copyright owners) instead, and the musicians will see almost nothing.

Don't forget that downloading may be considered legal now, but that intellectual property rights still see MP3s as copies of the original, which they are. You are only allowed to have one copy and only if you have the original which has been payed for. So legally you have to have the original of every MP3 on CD or the MP3 has to be purchased on the internet from the owner of the rights.
Today a Dutch court ruled that Kazaa is not liable for profit losses of the music industry due to sharing via Kazaa. Of course this ruling has no implications for the legal position of the uploaders and downloaders who use Kazaa.

Apple's iTunes is doing well, but its hard to see alot of people paying for music when you can still get it for free.
I would pay a small fee each month if downloading was unlimited and all the songs were good quality, but I won't pay 99 cents a song. I'd be up to about 2800 dollars.
