If you were going to turn it off, it's unlikely you'd care too much if it stopped working. Furthermore, Nissan never intended for you to turn it off, so the idea is that you don't, or Nissan won't like you very much.
However, it seems Nissan have installed a very fragile system in this car and lacks confidence in its abilities. They've failed to create a system that can be swtiched on and off without risk of harm, so they've gone for the next best thing - a cover-up. Now, that's bad.

The voided warranty is against the driveline, not the electronic traction control's ability to turn on and off.
