I like the way they are accepting donations (so far $30 I think) for videos that I have captured and provided for JW free of charge.

They say its not like really making money from the videos though as the money is being used to buy a better capture card and other equipment and that the BBC will understand and not mind as Top and Fifth Gear is not broadcast in the USA.

I am sure the BBC and channel 5 would be delighted that they are using the money to buy better equipment to ripp more of their shows off.

What of course will happen is they will draw the attention of the BBC as they are taking money for their shows and then they will be shut down...and then the BBC will probably make their way over here and try and close JW down as well as they will think we are something to do with them.

I would suggest that they are the selfish ones that through their stupidty and greed will ruin it for everyone.

Go to OPTIONS and then (under MAIL OPTIONS) click on Mail Display Settings and select Message Headers to FULL this will show you his IP (or at least it will next time he e-mails you) under the subject. You chose to make Justin Syder a moderator on your website which he uses to post his pointless crap about JW on....and therefore he is dragging you into this.

He has been banned twice from here and yet still comes back to take more videos that I have no doubt are then traded on your site. If that isn't bad enough he then sends me an email bragging about what the latest thing is that he has taken from me.

Where has the (at last count) $30 gone then that you have taken in donations if not into anyones pocket ?

The bottom line is you are paying for your website through someone elses copyrighted material and that makes you a bigger target than someone that isn't. I just hope that when you get closed down that you don't drag JW down as well.

Racingflix do not offer full programme videos for this very reason and we sure do not advertise the fact that we do or do not offer full videos for downloading let alone take any money for them.

Right, I have read the relevant copyright laws, links to which can be found later on in this post. Firstly, a breakdown of when one can use copyright material:

Under those commonly known headings, the initial caputure of any BBC/TV show is allowed under the guise of "Time Shifting". Obviously we have a problem in the distribution of the material.

However, I feel that there may be some ways around this. Firstly, there is a large distinction between the public in general and a society. Also, the same profit making issuses apply to both publisc broadcasts and sound recordings. Even donations, of any value above 1p will be considered profit. Profit does not have to be in the form of money either, the lending or giving of a valued item or service is enough to constitute consideration.

In terms of the distribution, on JW, one has to be a member of the 'Downloading club' in order to access the vids, which means that the videos are not for public access. On top of this, it has been made clear that a review of the video is expected, prompting discussion and criticism of the respective videos. The final aspect that works in JW's favour is the fact that any link to the video is requested not to be posted outside the forum. This has been strictly enforced in the past, with the banning of a member who falls foul of that simple rule.

The Copyright, Designs and Patents Act 1988 covers all aspect of copyright. The full act can be found here:

I would argue that the videos are distributed on JW as a non-proft organisation, for the purpose of analytical comment. The fact that they are only distributed to members of the 'download group' is further evidence of the intentions by all parties involved.

The issue of "sufficient acknowledgement" is deliberately vague. Including the titles at the begining of the video may be enough, but I would also recomed a small paragraph at the end of the video, stating the the purpose of the recording. I would also suggest a 'sticky post' in each download section, stating the the purpose of the videos e.t.c

I have yet to finish reading the act, so there may be more, or indeed something that completely destroys my argument. :wink:

I perfectly understand Demon's position... if we had to cut down drastically the number of users in the download club was also because we wanted to prevent such things.. sadly we can't be 100% sure that we have an asshole passing urls out or even justin using another nick.. it could also be simple somebody that download the vids and then pass them to somebody else via MSN or whatever...
If there is somebody passing out urls, he so far managed to keep the thing very silent and it's hard to believe there was no leeking so far to other people casing a more evident proof in the stats..

read the whole thread and then begin to post asshole. That gumball vid was hosted by me and ripped by AL123. Even viperbond posted saying that he "got" te file from someone. The reason you can get the file for free is because it doesnt cost him SHIT to pay for bandiwdth for the file as the file itself is not being sent by his webpage. That is what torrents are all about. With torrents, you upload at the same time you are dloading. So this crappness of "donate for better rips" is nothing more than BS (money for his pocket) since he does not even rip the vids, or at least not all of them. He just STEALS from JW and posts them as torrents. I hosted that gumball video and made my bandwidth for one month be met and more than half of it was met the next month (a total of 9$ paid by me and I did not and will not ask for donations). I even hosted one of the parts from MY computer makiing me have to have my comp on all the time and making MY internet connection slower. So what this guy is doing, is getting paid to steal from JW and steal from BBC since he gets money out of it, not like Jabba who loses money for entertaining others. He (Jabba) pays for this forum and he pays for the bandwidth and this is how he is thanked. He is thanked by having assholes like viperbond get the videos sent by other assholes who dont know how to respect rules and have assholes like you think viperbond is a nicer person than Jabba. Now if you understand how everything works then post your opinion. Dont just say "I love viperbond cuz I get it for free" you cheap bitch.

The full videos are not posted at RF so that makes it not ILLEGAL. Only parts of the show are posted there so that is ok.

Over here, in JW the full episodes are given to a small amount of people, but they are not charged for downloading. In other words, Jabba is not making money out of having the files be downloaded by users. In fact, he spends money and time by paing for bandwidth and buying TV capture devices. He spends time ripping and compressing the files and uploading to the server. All Jabba gets is gratefull people who post comments about CARS. He allows people who cannot see these vids (like me cuz I dont get that channel on USA cable) and post comment. His entertainment and the entertainment of others are the comments of what they see in the videos, not MONEY like viperbond's "support me plz"

viperbond SELLS the files. He gets money out of the files being dloaded. Even though he does not spent 1/999 out of the amount jabba spends, he gets money from people who want to "thank" him. His way of getting "thanked" is by getting money. Jabba's way is by having a group of car enthusiast post and comment about cars they see in these episodes. Now you be the judge and open up your eyes half as wide as your asshole and see who is doing the things wrong.

I was unhappy and could see the danger of another site openly advertising and using videos from here and accepting money donations for them...and JW being caught up in it all once the BBC find out what has been going on and get us shut down as well as viperbonds site.

The legal position has already been proved by the FIA shutting down many non-profit making websites that were posting F1 videos....

The bottom line is Top Gear is not in the "public domain" or in a library it is made by the BBC who charge us over £100 in licence fees to view it. They get to decide who can and cannot view it and thats that. It belongs to them and no one else.

That is why we do not openly advertise that there are any full copyrighted programme videos for downloading on JW and least of all accept any money for downloading them (if there were any to download that is :wink: )

I am not getting money out of anything Jabba isnt either, and as long as Viper doesnt then he falls under the same category as the rest. The thing that molested me the most was the fact that he opened up the DONATION. If he no longer does this, then that does mean he is not interested in money. If this is the case, then I have nothing to be mad about.

Anyway, what he should do is ask for Jabbas permision to host the files Jabba rips (or any other person like AL123) through bitTorrent. I know that if I take the time to rip something for a group of peoble, I would be pieced to know it is available somewhere I did not expect it to be. I dont care to host something so long as it is for the people I care about, that being JW users in the download group.

I dont have anything against anyone in particular, but I am not in favor of people doing something that affects others. If JW could be affected by him making the torrents available, then that is something he should discuss with Jabba before making a torrent available. In fact he cancelled this donation thing now to stop the controversies and will pay give back the money he received ($30 ?). Viper doesn't run his site for money period. IF he really wants to make a profit then why does he make downloads available for everyone?



I am not getting money out of anything Jabba isnt either, and as long as Viper doesnt then he falls under the same category as the rest. The thing that molested me the most was the fact that he opened up the DONATION. If he no longer does this, then that does mean he is not interested in money. If this is the case, then I have nothing to be mad about.

Anyway, what he should do is ask for Jabbas permision to host the files Jabba rips (or any other person like AL123) through bitTorrent. I know that if I take the time to rip something for a group of peoble, I would be pieced to know it is available somewhere I did not expect it to be. I dont care to host something so long as it is for the people I care about, that being JW users in the download group.

I dont have anything against anyone in particular, but I am not in favor of people doing something that affects others. If JW could be affected by him making the torrents available, then that is something he should discuss with Jabba before making a torrent available. The only thing I have against Viperbond is having Justin Stryder as a MOD. That is one guy who is only interested in one thing, VIDEOS.


Thanks for all your support DeMoN and great posts. I can see you and a few others can really see the point being made here and hence why you like me were absolutley spitting blood when you found out about the money thing and asking people to donate for new hardware etc.

It kinda made me feel like giving up as well capturing all this stuff for free when someone else was accepting money for it.

Anyway I hope its all being sorted out now and things can now return to normal.

I am sure that viper only had good intentions re the donations thing, if anybody took the time to visit his site and read the history of it they would see that it was not even his idea, and he was not that keen on the idea when first suggested. Also, I have wondered about the JW promo's superimposed on the 5th/Top Gear stuff, perhaps someone could offer a legal opinion about that. Surely a site with 10,000 members would be of more interest to the BBC than a site with 500 members

I am a member of all three sites (JW RF & Viper's site) and one thing I have noticed is the difference in the amount of flaming that goes on. RF being the worst by far, some people there cannot admit they are wrong about anything and sink to personal abuse all too readily. JW has a few members that fit the same description, but on vipers site, flamers get jumped on pretty quick. I know which I prefer
