i have recently been having a problem with a niehgbor..there dog just never stops barking i live in a duplex..so whenever i go outside to do anything it barks at me so we complained and the neighbors and i mixed words..i know it was wrong of me but i swore at them

i am 19 the neighbor is like 35-40

i was trying to build a sub box today..so because the dog never shuts up and i didnt want to get into it with the neighbors i did everything i could inside..got my cut all ready to be made and went outside to plug in the saw and drag the board out

the neighbors start yelling at me to get away from there fence and that im trying to make the dog bark...the wife said that so the husband says go out front and ill talk to u

he is usually calm and collected i figured it was a misunderstanding so i was just gunna simply go explain that i was just trying to cut my wood..i wassent gunna yell or anything even thought they had just bitched me out

so they guy comes running out screaming get off my front yard lard ass(i am heavy set..kinda hurt) so i was like wtf..so i try to tell him i was just cutting wood thinking i could still solve this with words...nope he comes to within 2" of my chest and starts calling me a fat fuck lard ass telling me to go F myself and telling me we could go right now he would kick my ass right here

i know that since i walked ot his door no matter my intentions getting in a fight id goto jail so i prety much ran back inside(very hard for me to pull my pride like that) then he is fallowing me to my door..i have a prety bad cut in my left hand so its prety much uselss i am also lazzy this dude seems prety fit for an old guy

so i acctualy thought he was going to bust down my door and whoop my ass i was acctually affraid i hate to admit it so i grabbed the batt behind the door and took 1 steep outa my front door now i know a weapon in public is a huge no no..but i acctually was affraid i was shaking in fear


sry guys i know its long it is just really really bothering me :(

so i call the police..the cops come dont talk to me first because he was outside so they talk to him..the neighbor tells the cops how i was standing next to the fence peeking over taunting the dor(was not) and i started swearing at them and i came to his frontyeard to have it out with him(i thought he wanted to talk nicely remember) and that i came all the way to the street with the batt

now his kids coaberate this..so the cop comes to my door and flat out tells me he should take me to jail for messing with my neighbors and brandishing a weapon in public..i try to explain what i was doing in MY OWN backyard and the cop wont even listin

then i try to explain to the cop that i only grabbed the batt because i was litteraly AFFRAID abig 200lb guy shaking because of his nieghbor..the cops like look at him look at u hes way smaller(WTF!!! I HAVE ONE GOOD HAND!) the cop then says if he has to come back out i would be arested

now i know cops dont like domestic things..but it is there job to protect the people..i also know brandishing a weapon is a no no..but i was really really affraid he was gunna come in my house and whoop me

so i mean am i totaly wrong for trying to use my backyard?? and am i totaly wrong for trying to protect myself? normaly i know a weapon shouldtnt be used but i only have the use of one hand for right now..

i wanted to join the AF but people like this kinda diswayed me..i tried and tried to just guff it out and let the neighbors do what they want i didnt even yell at him untill he started telling me to go F myself

it just makes me really really sad that this is how i have to live :( i helped these people move in for christ sake..i fixed there kids bike

if you do happen to you could take advantage of your country's wonderful law and take the 5th(your right to shut up and remain silent)

give it time he will be caught out. and be ready to call teh cops hopefully not that one like last time.

sue him, hit him where it hurts in the wallet, what kind of dogs are they? If big dogs it is fair to be afraid. Could be sued just for psychological damages. Don't put up with his crap. Avoid him send him a notice from a lawyer that if it continues you will see him in court.

I agree that the best thing is to tape it. You are in some tough position there though. If you just go to your backyard and do something without getting near the fence, I suppose your neighbors can't yell at you for being in your property. If this happened to me in my country, I would poison the dog, however, this cant be done where you live I suppose. The best thing would be to avoid contact with them but dont be affraid to use your backyard. They cant prevent you from being there!

don't be affraid of cops if they treat you like crap as for the supervisor and write his Badge Number. if you let them run over you they're just going to ignore you. get a neighbor to help you out or asked around your neighborhood see if they are bother by the barking. But for whatever reson never argue with the guy of the dog. My friend was sue because he told his neighbor if he could make the dog stop barking. My friend lost and had to pay up to $1000. man you live in California and the law here sucks. Get the cops involve call them at night when you can't sleep remember that the call can be anonymous, they can't give you name away.

hey mhn, sorry you are having a rough day bud. i really think the next time they have issues with you doin something in your backyard just mind your own business. there isnt a damn thing they can legally do. a court wont hold "just" testimony from them, in fact, unless they have some sort of pictures or video of you actually crossing their property and them telling you to get off and refusing, they dont have shit. just no more bats, just make sure you stay in your house next time, or let him come to you, that way its him crossing your property and there isnt shit for him to tell the cops. the cops couldnt have taken you in cause they didnt see shit except you inside the house, that was just them trying to scare you shitless. BTW, when he crossed onto your property there is nothing wrong with you having a weapon on your own property for defending yourself, just so you know. you can actually kill someone in self defense for tresspassing, but give him a warnign first next time, lol.

see the only reason for the batt is because my left hand has no grip right now because i cut it working with wood so its got 8 stitchs and a huge bruise..i didnt want to hit him with it i didnt even wave it around i just picked it up so he could see it..

and i had to take it well because i walked to him..like i said normaly he is the calm one so he normaly just talks things out..thats why when he said come out front and ill talk to u i went outside to talk to him and tell him it was all a misunderstanding and i wassent mad for them bitching me out...

he wassent on the door steep..he was walking towards the door steep about 10 feet from it..thats why i took out the batt for him to see so he wouldnt come any closer...any closer and i couldnt have swung the batt its to tight

my mom thinks the guy next door is trying to provoke me..we i should say i have had trouble with him before but its only after my parents leave..this one was about 20mins after my mom left

and it only happens when im the only one home he wont even look in my direction if my parents are home

now my mom is talking about what if he owns weapons..this is really not what i wanted to think about 2 weeks before my vacation..or at all in my life

If I were you, I'd go on about my business like it never happened. If the dog keeps barking, ignore it, let it bark. If you neighbors come out and start yelling and think you are teasing it, just ignore them. If the guy wants to start shit, he'll have to come into your yard and start it. Then all you have to do is call the police and tell them you did nothing to the dog or him. Tell them you just ignored it all and then he came into your yard and started yelling. BTW, him threatening to kick your ass is enough to have him arrested on the spot. You ruined that possiblilty by grabbing the bat. But if he does it again, call the police and tell them you don't feel safe with him around. They'll come and either arrest him or tell him to knock it off. The threat of being arrested will probably make him leave you alone.

Videotaping yourself while you are in your backyard seems like overkill. If he comes into your yard, he starting it. If it ever comes to the point that he actually hits you, don't hit him back. It's hard, I know. Just go into your house and call the police. Then you have him nailed to the wall. Not only will he be arrested, he'll have to post bail if he wants to get out right away.Then he has to go to court, and depending on his record, he might get jail time, community service, parole or maybe even house arrest. Then of course, if he actually hits you, you could sue him.

mhn, sounds like a bad rap of a neighbor where things started just fine, and all... ive had something similar happen with a neighbor my sophmore year of college. i went out, met the neighbors in the apartment complex, had a good time, hung out with them and all, then a few of them snapped one night. i wish i could say it was because of something i prevoked, but it basically came down to them being straight up asses.
my advice is this, it may seem gay, but write the family a letter. it never does anybody any good when they read something about them that they dont like... just feeds the fuel. so just keep it plain and simple, and mabey it will be the same as it was before he erupted.
