I don't think there would be any grounds to charge the old guy in any jurisdiction. He acted instinctively to protect his life.

I wish we had US laws as far as self defence goes...The Canadian ones are pathetic....here basicly all you can do is fight back with equal force...and killing someone your doing time regardless it seems.

^Yeah, I don't think killing a mugger is entirely appropriate, but the thing is, he was probably so freaked out by the incident that his instinct was to crush him until he stopped moving, by which time he was dead.

If the mugger threatened him with death and wasnt running away.. Then he was justified. You cant sit there and think well maybe he wont use the gun when your lifes in danger. And the reality is, as anyone will tell you, in those situations you must 'shoot to kill' or in this case choke to kill. Anything else endangers everyone else and yourself.

/\/\ That is very true but weirdly it doesn't work that way in this country..

Last year a colleague of my neighbour (who is with the police) was attacked by some Moroccan kid with a knife, he took his gun and shot him, the kid died. Then it went to court and the policeman was convicted, he wasn't charged with manslaughter but something else, he was discharged from the police. Just wrong, so wrong IMO :?
