...GM had two goons - Mr Duran and Mr Chiros arrive on my doorstep this evening.

They carried with them a folder of evidence.

Seems they think I stole their property by posting the copy of a link on a forum with a question "Is this old C6 news".

The gentlemen were not satisfied with my answer that "I simply posted a link I found".

And left me with this comment".

General Motors will not let this lie - and we will spend millions of dollars to prove a point.

Nice guys we are dealing with hey... :)

So I guess I am off to secure a lawyer tomorrow.

(hey - If I need millions of dollors to defend myself - since I didn't steal any images - how about a $5 donation from everyone towards my lega fund.. :( )

sounds good to me RC. But honestly i really don't think that GM has any kind of case against you. sounds like the Gestappo(sp?) is just making their rounds :fist:

they would have to prove that you persoanlly stole the pics from them somehow. and since they have yet to actually trace the source of the leak, i'd say you're in the clear. (besides, the C6 has already been released so doesn't that make this a moot point?)

but keep us posted anyway.

No - it was apparently a screen capture of an image.

That's it.

Now I know I did nothing wrong - but the process of proving as such could prove to be a rather stressful situation.

This is where we get to think about what can say GM do, if you did have copyrighted images on your harddrive... afterall, everytime you visit their website (or anyone elses for that matter) your browser cachse THEIR property on your harddrive.

I think it's embarrassing for a major company like GM to go after private persons like this. I'm not to familiar with the american legal system but in Sweden (where we practice "code Napoleon, like I think you do in USA too) they would have no case at all.

I never said I was surprised they could find him. I was just saying it's probabily illegal for them to find him and approach him like that. At least in Canada it is illegal. Maybe in the states the laws are different. But I'm sure RC will fill us in on that tomorrow.

Even if u were to take pictures of car that is under developement in GM's own private proving ground and post it all over the internet, that would still not be illegal unless they can prove you actually transpass into their property doing so.

I think they already know you're not who they're looking for, because it has either to be a good hacker or an employee or someone else who had access to the picture.

I sure hope they won't try and make an example out of you. I'm no expert of US law, so I don't know whether they have a case or not. Even in the case where they know they don't have a chance they could still do some damage if they wanted. I'm hoping for the best. Good luck with this and let us know what your lawyer said.

I would not lose any sleep over it until the they serve a claim form and the particulars of case (or US equivalant) . Only then will you know what grounds they are taking you to court over. Then, you/your solicitor can just reply to each section with deny or prove. I would love to see them try. I would feel embarassed if I was working for GM and trying to goto court with such a week case. I hate it when big companies try to apply pressure to 'small' people.

Indeed...I don't think they've got a very much of a case on the whole against you as the "source" of the leak, as I think it'll be fairly easy to prove that you weren't the originator of the photo. The worst thing they could do is probably subpoena you and your computer. If that's the case then whatever is on your HD is public domain for the case, as well as any logs with respect to what posts you made where and when they occurred. The other issue is that once they find out where the photo came from then it's possible they might try and say you're an accomplice because without a doubt, you did post the photo and help it spread across the internet. However, with that in mind, they've got an awful lot of us to sue if that's their line of reasoning.

As for US law regarding internet privelages, it's pretty easy to come by people's information from their ISP. All that has to be done so far as I know is that someone has to fill out a simple form, and send it to the ISP as well as to some lower court in order to make it "legal". The way things work in my experience is that the ISP doesn't even bother to make sure it's fully legal and will hand out info with reckless abandon. I wish there was more privacy these days.....

There were these hackers that basically claimed that they shouldn't be prosecuted because there is no way to tell that they were the actual hackers. Pretty much blamed everything on the computer. Just a thought.

that could have been any employee with access to Centernet (online resource center for sales and service) it had been posted on the Centernet site about 2 weeks ago, but it was in german.

i don't think BMW really cares all that much since their cars are always spotted on the NS. Once the spy covers are removed, it's pretty much the final product. They might clean up a line here or there but what you see in the vidz and pic from the NS is baisically what you're going to get.

When the Z4 came out, all the US training centers got 1 or 2 of them as trainers but since they were pre-production and hadn't been officially unveiled (i got to work on the SMG and 6spd while i was in training, both were prepro and we had a problem getting parts AND accurate wiring diagrams) It hadn't been spotted in testing without it's covers so BMW was realy serious about making them keep ther cars covered at all times when they were parked outside. but once the pics came out, the covers no longer had to be put on.

it's not like it's going to cause the loss of sales, or there compeditors are going to get inside to make better cars.. there compeditors alredy make better cars :twisted:

LOL, i cant believe the cheek of GM to do this, as you said RC an Email, a Headed Letter > fair enuff, but a couple of goons. That is just fucking ridiculous. I hope you give em what they deserve. And IMO the pictures in question could be seen as 'artists impressions' maybee that someone knocked up after seeing the spy shots of the C6 in its disguise. Its not as if its a photo!?
Just pathetic on their part.

Sounds like they are too lazy to look at their own organisation for the person who leaked it and are looking for a scapegoat.
